why do we need the torah to justify our rights to the land?

In fact, using the torah undercuts our rights to Israel.
#1- we took the land through genocide, according to the torah. By what right can we have rights based upon successful genocide?
#2- the other right in the torah is that god gave it to us. How do we know god gave it to us? Because the torah said so. Sort of an illogical loop that does not convey any rights.
I propose that we stop trying to justify our rights to the land. We don't need to. We are here.
