I am not going to comment on those scandals. I dont think we have enough information to know what really happened. I personally don't understand much of what has been reported or the ramifications of what was supposedly done and who was doing illegal things and who was hurt by those actions...
That being said, I will say these arguments and investigations and exposes and attacks and all that are all superfluous. There is one thing that is needed that will get to the bottom of everything. If we would have a State Commission of Enquiry, the investigative body that PM Netanyahu has blocked from day 1 from being established, it would look into all these aspects of what was going on and we would get some answers. But since we cant have a formal investigation, we have to rely on isolated investigations, isolated incidents, leaks on specific issues and then argue about who is really responsible and who really did what. Just set up the formal investigation already and let the people start getting some real answers and the fuller picture of what happened.

The problem is that nobody trusts the investigators. For the pending criminal charges [1000/2000/4000], numerous laws were broken by the prosecutors office (e.g. illegally opening the investigation in the first place without proper approval, illegal wire-tapping, illegally harassment of states witness, etc etc), and no credible evidence has been presented to date. Exculpatory evidence was illegally HIDDEN from the defense, and they got CAUGHT and publicly lied about it. They even MADE UP a "crime" to charge Bibi with (since 2018, I am not familiar with anyone ELSE charged with media bribery - why is that?)
ReplyDeleteMaking it worse - the judges and prosecutors, etc FALSELY claim to be 'non-political' and above the fray.
As for October 7, a State Commission of Enquiry IS a problem and is not neutral, since (i) it would be chaired by a former Bagatz judge; and (ii) by definition it would not investigate the influence of Bagatz decisions on bringing about October 7 -- Hayut is CONFLICTED. For example, Bagatz prevented the IDF for carrying out 'extrajudicial executions' of Hamas leaders, prevented the IDF from having a 'shoot to kill policy' for Gazans approaching the border fence [such a policy would have PREVENTED Oct 7], and the list goes on.
I note that the law for 'State Committee' headed by a former Supreme Court judge was enacted more than 50 years ago, when the Supreme Court was NOT the politicized body we have today, and enjoyed a DESERVED high level of social trust.
I say State Commission of Enquiry because that is the only legal body authorized to conduct such an investigation. If they can come up with another way of doing this and create some body that can do such an investigation with authority and ability, that's fine by me. I saw int he news this morning that Netanyahu is working on coming up with such a body. I am not sure why a body created by Netanyahu that might be beholden to him is less of an issue (of being impartial) than a State Commission, but so be it. I would note that in the past Netanyahu has called on the use of a State Commission of Enquiry to investigate others, such as Olmert and lebanon, and then he wasnt so worried about if it is partial or impartial.
ReplyDeleteBecause it will always be partial to others.
DeleteThere will be no commission of enquiry because both sides have too much to lose.
ReplyDeleteBibi will lose when it turns out his policy of constant appeasement of Hamas for over a decade turned into a disaster.
The AG will lose when its widely publicized that she blocked the army from responding for hours on a legal technicality, just to make it look like Bibi dropped the ball.
The Left will lose when all the evidence that they knew about this attack and didn't tell Bibi all about it what they knew while ignoring the imminent warnings.
