Proposed Law: doubling prison time for recalcitrant husbands to free agunot

good news in the fight against people who withhold a get during divorce proceedings rendering their wives as agunot..

The law already allows for the arrest of a recalcitrant husband upon the orders of a beit din. MK Michal Rozin (Meretz) is proposing to adjust the law and double the amount of prison time they can slap onto the recalcitrant husband. Currently the laws says they can stick him in jail for up to 10 years - if Rozin's bill passes, that would be changed to 20 years.

Rozin explains that there are a number of recalcitrant husbands sitting in jail today for many years. This adjustment would allow the batei din to implement the law and minimize the number of such cases, thus freeing up agunot. This will help the women who are being "jailed" by their husbands..

The proposal passed its initial reading by 16 votes in favor with no opposition, and will be prepared for further readings.

I am not sure why they think that if someone is willing to sit in jail for 10 years rather than give a get he won't also be willing to sit for 20 years. Neither makes sense, but people sit there and continue to refuse to give the get. I assume changing the law to 20 years will not change things, but I hope I am wrong.

  1. I wonder why someone hates his wife so much that he would be willing to go to jail to avoid giving her a get. This is not ethical Jewish behavior in any sense.
