Eichler's explanation about his opposition to the stone throwing law

By now everyone knows about the storm started by MK Eichler when he stated opposition to a law to crack down on stone throwers because Haredi stone throwers would get arrested because of it.

A reader of this blog (SB) wrote to Eichler expressing his shock about such support, and his hope that Eichler will retract what he said and his stated opposition.

Surprisingly enough, Eichler's assistant actually wrote back!

To be fair, I am repeating here what Eichler responded (via his assistant)..

שלום רב,

קראתי בתשומת לב את אשר כתבת בענין זורקי האבנים.

כנראה שהנך נסמך על כותרות העיתונאים, וטוב שפנית.

גם בתקשורת פורסם מפורשות שח"כ הרב אייכלר אמר כי כל התפרעות בהפגנה ראויה לגינוי ולמעצר.
ח"כ הרב אייכלר מתנגד לחוסר ההבחנה בחוק.
חוק לקוני של 20 שנות מאסר על כל מיידה אבן, פירוש הדבר שכל שוטר או שופט יוכל להעליל על מפגין אתיופי, ימני או חרדי כאילו זרק אבן ולהושיבו במאסר ל-20 שנה.

לאחרונה התוודעו כל אזרחי ישראל לתופעת עלילות השוטרים על מפגינים שמימשו את זכות ההפגנה כחוק ונאלצו לבלות במעצר, ורק בזכות מצלמות שקלטו את הרקע לאירוע ניצלו מאישומי "תקיפת שוטר" וכדו'.

רצו"ב תמצית דבריו של ח"כ הרב אייכלר שנמסרו לתקשורת:

"כל התפרעות בהפגנה, ראויה לגינוי ולמעצר. אך אסור לתת בידי כל שוטר או שופט אפשרות להעליל על כל מפגין, שזרק אבן ולהושיב אותו ל-20 שנה".
"בחוק אין הבחנה בין היסוד הנפשי של מטרת רצח וחבלה באבנים, לבין כל התפרעות בהפגנה.
הדבר דומה להטלת 20 שנות מאסר על נהג הנוסע 60 קמ"ש בעיר כדי למנוע פיגועי דריסה של מרצחים"

אין אנו אחראים לכותרות שנוח לכלי התקשורת "להדביק" לכל ידיעה, כדי ליצור באז ולזכות לתשומת לב.

Basically, Eichler clarifies that he condemns all violent outbreaks at protests. What Eichler opposes is the lack of differentiation in the legal application. To explain, a laconic law condemning a stone thrower to 20 years in prison means that any policeman or judge can accuse an Ethiopian or a Haredi or a right-winger of throwing a stone and then throw him into jail for 20 years. He says the law is comparable to giving 20 years in prison to someone who drove 60kmph on city roads in order to prevent terrorists from using car attacks. The law does not differentiate between people have intent to kill when they throw rocks, and between people protesting that get violent.

He blames the media for skewing his words in their headlines and articles.

The truth is, he does not really change anything from what was quoted, except that he stressed that he condemns violent outbreaks in protests. He even was quoted as saying that in the original, but it was given less importance. He is still saying that haredim who throw stones should not be treated the same.

And, just like it is not ok for a policeman or judge to falsely accuse a haredi or ethiopian or right-winger of throwing a stone in order to throw him in jail for 20 years, it is also wrong for them to do so to an Arab. The law should not allow anyone to be abused like that by the authorities.

  2. It seems as if Eichler accepts "our" rock-throwing as a fact of life. Let's see Eichler and his party colleagues begin to do their utmost to prevent "our" guys from throwing rocks altogether. Then the severity of the penalty shouldn't matter to them. A rock doesn't suddenly lose its injurious or lethal force because one of "ours" throws it. Does Eichler propose setting up a two-tier system (us and them) for punishing other crimes, too?

  3. Policemen can say what they want. If Eichler wants to use his influence as a lawmaker, he should make the law enforceable with adequate proof. Maybe nowadays it's fair to require video before locking someone up so long. But to say the law will be unfairly applied? Please.
