Ronen Bar's declaration
Ronen Bar, still head of the Shabak for now, submitted his declaration to the Supreme Court to explain why he should not be fired at this time (though supposedly he said he will resign soon anyway). and has created quite a stir.
In Bar's declaration he revealed some titillating information about Prime Minister Benjamin Netanyahu and some of his requests of the Shabak over the years including to collect information about leftist protestors, and to stand by the government in any situation of a constitutional crisis, and more. And this is just the portion that was made public. There is another portion of the declaration that is top secret and "for your eyes only" so we dont know what is included in that portion.
Obviously the Prime Minister's people, if not he himself, will declare it all lies and an attempt to bring down the right wing government.
And maybe it is.
We don't know. it is his word against his word, and we the simple people have no way to know who is telling the truth. Unless Bar has documentation and recordings, it is all hearsay.
All that being said, besides for possibly the "Qatargate" investigation that might be considered a conflict of interest, I personally do not see why any of this (not including the top secret portion of which we do not know the content), exciting and titillating as it might be, would be a reason to prevent his firing. Even if it were all true and this shows PM Netanyahu to be dangerous to democracy and to the State of Israel (which he is anyway, considering all the major tragedies that happened under his leadership), seemingly the government has the right to fire the head of the Shabak, unprecedented as it may be.
I still think it was a mistake for the Left to take on Ronen Bar as a sacred cow and protect him and protest on his behalf. He played a massive role in the failures of October 7, and he should not be protected. At most they should have used him as an example to demand more "responsibility" and resignations, not protect him to keep in his position as head of Shabak.

DeleteThere's a difference between "happened under" and "his fault." At least some of those things may be said to have been his fault.

This is the way I see it.

Is there a process that the Government could have followed to properly fire Bar? - Yes
Did the Government follow the process? - They intentionally made it a point not to.
Does the Government have just cause for firing Bar? - Unclear
If the Government had just cause for firing Bar for the reasons stated, why did they wait 18 months before initiating terminations proceedings? Was he incompetent for those 18 months or not? If yes, why didn't the Government try to fire him?
Bar's response gives evidence that his firing is not about competence and more to do with unreasonable expectations put in place by Bibi. If that is the case, that would make his firing arbitrary.
If the firing is with just cause than he deserves to be fired. If his firing is arbitrary having to do with Bibi not liking him and not about his level of competence than his firing is illegal.
This could have and should have been resolved before it ever made it to the courts.
It's possible the Government wanted the firing to be held up by the courts in order to give more momentum to their push for Judicial overhaul.
I don't know what the truth is, I'm not a legal scholar nor even a minor expert in these matters but I did read that the government does not need cause, it can fire the shabak head on any whim, it just needs to follow the proper procedure. If that's correct, and I don't know it is but think it is, they can fire bar without cause, just for waking up on the wrong side of the bed. Unless there is conflict of interest or some other similar type of conflict. Not sure. This government though thinks the laws don't apply to them, they were written by leftists. They think they don't need to follow procedures. They are basically trying to burn the country to the ground and dismantle all the state institutions and turn everyone on each other

DeleteWith Bar, I would suspect the reason its taken so long is because, like every other centre-left leader or important person out there, at some point he was probably a friend of Bibi's and then turned on him due to his corruption.
ReplyDeleteHowever, the government is correct in this situation. Bar is a government employee and the government has to right to fire him. In steps the AG and the Court to say they can't. Uh huh.
The AG is an employee of the government with defined duties. She has unilaterally turned herself into the government's nanny and demands they follow her orders. Uh huh.
The price of democracy is the risk of electing a lousy and/or corrupt government but that government is still the legitimate ruling power until the next election. The AG and the Court seem to be defying that by only permitting the government to do what they allow. This is just not acceptable in a democracy.

DeleteThere's no question that there's tremendous "inbreeding" on the Left's side. However, I have a feeling that even if Bar wasn't a close personal friend of the AG, she'd still have defied the government simply because that's what she's sees her job being.

DeleteMy point is this: Any lawyer should be able to see two sides of an argument. If the government wants to do something that is not completely illegal, the AG, as a representative of the government, should err on that side. Otherwise she should find a new job. That's what being a lawyer *means*.
Yes, that's totally the point. She is an employee of the government and her job is to follow their instructions. Instead, she's reversed it.
