Proposed Law: Kosher Competition

In light of the Kosher Mobile Phone Reforms passed by Minister of Communications Yoaz Hendel yesterday, MK Moshe Arbel (Shas) has proposed a law that would set the situation backt o what it was with some improvements.

Arbel has proposed that the "koma ksheira", the system of the kosher phones that existed until now continue to exist and it be put back in place but the ability to port kosher numbers between kosher companies, between koma ksheiras, be added.

In the law proposal Arbel explains the purpose of the law being to allow each person to choose on his own of his own free will what communication services to use and this will allow him to protect himself as he sees fit.

As an aside, this is exactly what I proposed as the compromise solution - establish competingg kosher authorities and companies and allow the porting between them without allowing the porting from kosher to non-kosher and without dismantling the entire kosher authority, just establishing competition within the existing system.

What I find interesting is that they are all talking about freedom to choose but that really was not taken away. Every single person has the freedom to choose what type of cellphone service he or she wants. If someone wants kosher service, they can sign up for kosher service. What was taken away was the ability for some people (aka askanim) to force other people to choose something specific. In the name of freedom they are demanding the ability to go back and take away other people's freedom to choose. nobody is stopping anybody from getting a kosher phone - the reform just gives mroe people the ability to choose what they want.

Kosher For Pesach phones

People used to joke when having two items that one is for milchigs and one for fleishigs. And if they had 3 they would add that one is for Pesach.

While to me this just looks like a clever ad for a cellphone business in the form of a pashkevil, it claims the support of rabbonim and poskim for the need.

This pashkevil, the broadside, pasted on walls in Haredi areas (this one specifically in Jerusalem), claims there is a concern for the rpesence of chametz as we always use oru phones around the year and there is no way to keep them clean and form the record of repairs they regularly find chametz int he hones, one should get a new phone for Pesach. So this business is selling rabbinically approved phones special for Pesach. If you get a new clean phone, you will be able to enjoy the Pesach holiday without concern that a crumb of chametz might fall from your phone into your food.

So now the kosher phones hechsher should also say "not including Pesach" as does the hechsher on food items, and there should be a separate hechsher for kosher for Pesach phones....

kosher cell phones

this kosher cell phone situation is confounding.

the State has decided that the people administering the kosher cell phone arrangements have basically been abusing their powers and blocking lines, even emergency lines and other important lines willy nilly, in addition to overcharging and basically using it as a source of income and control over the Haredi community. The State therefore has decided to cancel the entire arrangement.

The Haredi askanim are fighting this tooth and nail. They say it is vital for the community.

I have no problem with kosher phones. If that is what enough people want, the service should be provided (assuming a mobile provider wants to provide it). There is a problem that allowing these kosher phones to stay on the market is holding back technology, due to the need to keep the old cell towers up, but if the companies are willing to do it to get the business, that is their decision. And if they can find a way to push the kosher phones to newer technologies, even without Internet access, they should be doing that and phasing out the old over a period of time.

Basically, I see nothing wrong with companies offering a kosher phone service. I think it is perfectly reasonable to put this in the hands of the consumer and the mobile provider, and take it out of the hands of the askanim. I dont think the kosher service needs to be done away with, but it can be administered just like any other phone line. Someone who wants a kosher phone line should be able to sign up through Golan or Hot or Partner or any other company willing to sell kosher lines.
