support Magen
Today, I hope you'll join me in supporting this important cause:
In the aftermath of the Walder catastrophe, the number of victims and survivors that turned to Magen for support has drastically increased. Some called to disclose their abuse for the first time while others felt triggered and overwhelmed by the news and needed support, knowing that Magen was the address to turn to. Dedicated staff has spent countless hours fielding calls and offering resources and a listening ear.
This expose has raised critical awareness to the destruction that is sexual abuse, and has left us feeling helpless. Magen has been there all this time, doing the work we are unequipped to do, and they need our help to continue saving lives, ensuring abusers are answerable to their crimes and helping one survivor at a time ( sometimes multiple at once).
Please join me today to Magen's campaign, to ensure they have the resources to go on smoothly.
Every bit counts. Thank you so much!

Sexual molesters on alert!
An "Admor", around 70 years old, was recently arrested in Bet Shemesh (just announced in the news) for child abuse and sexual molestation of minors. Details of his identity are not yet available to the public as there is currently a gag order on it.
From what I hear, the only thing new about this is that he was arrested but he has been bouncing around from Haredi community to Haredi community for a few decades already with rumors and allegations about him all along.
After the Chaim Walder case came to light there was a lot of talk if the Haredi community will change. That seems to be the discussion any time anything monumental happens to society, such as elections, such as Corona, etc.
I dont know about sweeping changes to the way Haredi lifestyle is but I do know, and it seems clear, that the younger generation has turned a corner at least on this issue and will no longer continue just sweeping it under the rug. people are speaking up. The tipping point on sexual molestation has been reached. This genie won't be put back into the bottle. All molesters or potential molesters should be aware of that - the people wont be easily silenced any longer. You likely wont get away with it the way you used to.

moving forward from Chaim Walder to supporting victims
Rabbi Aaron Lopiansky wrote a fabulous article in Mishpacha about the Chaim Walder case. It is actually less about Chaim Walder and more about what we as a community must do to improve our response to such situations and to support the victims.
Rabbi Lopiansky talks about hos badly the victims suffer and the difficulty they have in speaking up because of the community reaction and support for the person who perpetrated the violence and abuse. Rabbi Lopiansky says we have to stop looking at such incidents as a crime or aveirah, rather as retzicha - murder, taking into account what it does to the victims.
Almost the entire article is gold. My only comment is his proposed solution. Rabbi Lopiansky's solution is to create a forum. A well-respected forum of people form the community that will seemingly investigate any such claims and determine if they are serious or the work of a disgruntled student or parent or whatnot. Such a forum would require standing and public respect, along with training and access to experts and access to leverage.
That might be a good start, considering the realities. The realities being so many rabbis not willing to say "go to the authorities" when a congregant comes forward with a question about what to do. The reality of people asking a rabbi before going to the police.
The real problem is that this is all part of the problem. These forums are mostly useless. They are useless because they have no actual authority and because they have no ability or expertise to properly investigate these matters and make a determination, let alone to impose some sort of punishment and enforce it upon determination of guilt. These forums are really just a way of keeping things within the ghetto, more often than not keeping it quiet, with the perpetrator free to leave town and move on to victims in another place with no actual deterrent.
As a start, it might be the beginning of change, but the forums and batei din are not the answer. Giving them the power and authority and ability is nothing but a pipe dream and is not realistic. They have no real way to enforce anything and there will always be another rav or dayan or community leader that will reject what this forum concluded, leaving the community divided as it is now. With Eli Pelay's addition of creating some sort of network so that people can't just move around to a new community and start again, it could be the beginning of change. A registry of molesters and pedophiles is necessary but it cant be run and administered by an internal forum or beis din. it has to be run by the State and courts, or else in the end nothing will have changed.

Quote of the Day
As far as Halacha [Jewish traditional law] goes, any [sexual] abuser falls under the category of ‘rodef’. If we wouldn’t have a government and laws, we would have to shoot him at point blank range. [But] every city has courts which deal aggressively with the issue.

Walder's suicide
Just to remind everyone, Chaim Walder is not the victim.
His victims are still the victims, and now that he committed suicide, his family is as well. I feel bad for them - for the victims.

Chaim Walder needs to be sidelined until it plays out
Chaim Walder, accused of rape and molestation of young girls, is a difficult situation. Walder is super-mainstream in the Haredi community, in addition to being a celebrity and a leader and very "out there" with his books and articles, and he runs organizations and helps children... These situations are difficult. As in almost all similar cases, he has those supporters who say they don't believe it, he could not have done it, he helped me and I never saw anything suspicious, etc. Then he has those saying we can't operate a field court and decide he is guilty, we cant hurt his parnassa, he passed a polygraph, innocent until proven guilty, someone must be trying to take him down, we cant trust a newspaper report - let alone Haaretz, this is against halacha. Then there are those that say there are too many accusers for there not to be something there, the newspapers, especially a serious one like Haaretz, investigate thoroughly to the last detail before publishing so they wont get sued, we have to support the victims, if true every moment he remains in public leadership with his support of the community is hurtful to the victims, etc.
It is true, we cannot run a field court, deciding he is guilty based on a newspaper article with anonymous sources. But when there is such a serious accusation, and perhaps multiple, we cannot leave him in his position of power with access to more children and with the risk of him using his power to influence the community and even more victims. Nobody is putting him in jail, at least not yet, but we have to act on the serious allegations and deal with the suspicion.
After an initial period of quiet from the Haredi leadership, today Kol Hai has suspended the Chaim Walder radio show. Yated Neeman has supposedly decided to suspend Walder's regular column. I think these are good moves. I think responsible parents will not send their children to him for therapy or advice or assistance or whatever he has been doing with children. I think schools he teaches in should put him on temporary leave (which could become permanent). I dont see any other way.
Eichler's in Boro Park has taken the difficult position to remove his books from their stores and from their website.
This is starting to snowball, and while the situation is sad and upsetting, I think this is the proper public approach. some form of "kabdeihu vchashdeihu".
It is not for me to say you should be throwing his books out of your house. Do what you feel is right.
This situation needs to be let to play out, and he needs to be sidelines publicly until it does.

Yehuda Meshi Zahav's suicide note
The Yehuda Meshi Zahav situation, which went from bad to worse, from horrific to tragic, was one that I did not really have anything to say about. What he was accused of was horrible, the supposed cover up, for years, was horrible, and if true everyone involved should be punished harshly.
Today's suicide attempt that left him in critical condition added an element to the story. As if the family has not suffered enough, now they have this painful incident to deal with as well.
But now somehow his suicide note has been leaked to the news media.
in his note he says he has already received his punishment. he implores people to remember the good he did, and to always remember what he himself forgot - there is a watching eye, a hearing ear and all your actions are written in a book. He signed the note saying I always loved you and am very embarrassed.
When I first saw this a short while ago, I had two initial immediate thoughts.
My first thought was to wonder why this is not a personal family matter and why was this released to the public. How dare the police publicize this, unless they got permission from the family - but if so, the release should include that information, that the family chose to publicize it.
A short while later Meshi Zahav's lawyer put out a statement claiming this note is fake and it is not his signature or handwriting. So, if true. that is just cruel on the part of whoever put it out - not cruel to Yehuda Meshi Zahav. I dont care about him, but his family did not do anything wrong and they are suffering enough. There is no need or benefit in being cruel to his family.
My second initial thought was to wonder, if the suicide note is not a fake, could this be used as evidence of guilt, an admission, in court, should he survive. or should his victims choose to sue his estate for damages if he dies.

it isn't a parnassa question
Rav Baruch Dov Povarski, the Rosh Yeshiva of Ponevez, made an interesting comment that made me wonder.
Kikar reports that a school administrator went to Rav Povarski to discuss he can force his teachers to vaccinate against COVID-19. Alternatively, could he put any teacher who refuses to vaccinate on furlough or unpaid vacation - and this possibility would possibly be used to persuade teachers to vaccinate.
According to the report, Rav Povarski responded that this is not a Choshen Mishpat question - it is not a financial question of whether or not it is ok to affect someone's job and income in this way, but it is a question of whether or not such a person is appropriate for being a teach of children. Someone like this has no sense of responsibility, he might cause his students and their families to get sick and get injured and damaged, perhaps such a person is not worthy of being an educator.
Furthermore, Rav Povarski said, the gedolim have said that everyone should get vaccinated. This teacher thinks he is smarter than the gedolim - such a person is not appropriate for being an example in the education of children.
On its own, in its own right, this is an interesting position to take.
But the way he said it made me think of something else. The way he discussed about it not being a parnassa, a choshen mishpat, question but one of education made me think about another situation in which these issues adversely overlap at times.
I am talking about abuse in schools by teachers against students. Physical, verbal, and especially sexual abuse. When we hear of such accusations, often the response has been to be extra "cautious" and protective of the accused teacher so as to not harm the parnassa of the teacher. Often it has been dealt with quietly, with the teacher quietly being sent packing but to another town to get a teaching job somewhere else (aka NIMBY - not in my backyard). Rav Povarski's approach to teachers and vaccines if applied to those situations equally would say it is not a parnassa issue, such a teacher is not worthy of teaching Jewish children and of being an example for them.

Goodbye, Malka Leifer, and don't let the door hit you on the way out
With the airports being shut down today for at least the coming week, Malka Leifer made it onto one of the last flights out of Israel.
Leifer was extradited to Australia and banished from the country early this morning. 6 long years of trial after trial and appeal after appeal and protection from the highest levels of government. The Israeli chapter of this story has finally come to an end and now Leifer will have to fight for her claim of innocence in Australia rather than fighting for her claim of illness in Israel.
Good riddance to Malka Leifer, even if only to get her and the danger she presents away from Israel. Israel does not need to be a safe haven for people like her.

sending Malka Leifer home
Ynet is reporting that Justice Minister Avi Nissenkorn has just signed the extradition order to send Malka Leifer back to Australia to stand trial there in the abuse cases filed against her.
The courts recently rejected her last appeals attempting to block extradition. Nissenkorn's signature is the last step, from what I understand, necessary before sending her back to stand trial.
I thought I would be happy when this day would arrive. If this day would arrive. It was not a given. There were many obstacles and Leifer avoided facing justice for a long time with false claims of health and mental issues in attempts to avoid extradition, along with [alleged] political interference.
I thought I would be happy, but now that it is here, I am not. I think it is a sad day.
Not sad because I feel bad for Leifer.
It is a sad day that it has come to this. The entire situation is sad. What she did, the suffering of her victims [alleged] ,how she tried to avoid facing her accusers and justice, how she spent years hiding out besmirching the frum community by association, and even though extradition is necessary it is still sad that it has to happen.
This might be what has to happen, and she might (or might not) get what she deserves, but that does not necessarily make it a happy day. The entire situation is upsetting.
I titled this "sending Malka Leifer home" because of an interesting tidbit in the review of the final case. Ittay Flescher pointed out on FB the following:
Leifer’s lawyer Nick Kaufman claimed she shouldn’t be extradited to Israel as while she was in Australia she always saw herself as an Israeli, and even asked a teshuva about how many days of yom tov she should observe, with her Rav saying only one, unlike other Orthodox Australians who observe two. Therefore, Kaufman argued, the centre of her life was in Israel and serving a sentence in Australia would cause her additional pain.Judge Yitzchak Amit responded to this argument in point 22 of the judgement by saying he couldn’t accept that Leifer’s connection to Israel was so strong that her serving time in Australia would cause her “more than the usual” pain suffered by other prisoners. The evidence he gave for this assertion was that Leifer only chose to leave Australia after her alleged abuse was revealed, implying that had this not been revealed, she would have had no problem staying in Australia for many years longer.
So, Leifer is being sent home.

Malka Leifer declared fit for extradition!
As they say, it ain't over till it's over. Or until the fat lady sings. Whichever comes first.
The District Court just ruled the Malka Leifer has been faking her mental illness and is fit to stand trial. The court will now push forward the extradition process so that Leifer can stand trial in Australia for the heinous crimes she is accused of against minors who were her students..
as mentioned above though, it ain't over till it's over. the expectation is that her defense lawyers will now appeal to the Supreme Court and any extradition process in place will be halted until the Supreme Court decides the matter.
In the meantime, if Litzman had to leave the Health Ministry just for this to happen - dayeinu!

Father arrested for breaking son's phone
Kikar has a story of a father who was arrested for breaking his 15 year old son's cellular phone. The mother, his wife, called the police on him and they came to the home in Geula neighborhood of Jerusalem to arrest him.
While this fellow has no prior criminal record, he was accused of violence against electronic devices in the home before, and was accused of violence against the children in the past but at the time denied the accusation and nothing came of it.
The courts denied the police request to extend his detention but released him to house arrest to be located in a local yeshiva. He will not be allowed to leave the yeshiva without permission form the court. He is also not allowed to be in contact with his wife or children. The purpose of this is so that he will not impede the ongoing investigation in any way.
It sounds to me like this fellow is abusive to his family. While he has found ways to avoid getting in trouble for it until now, it looks like the mother has had enough. For her to call the police over a broken telephone? Looks like this is far bigger than that.

Rabbi Greer Headed to Prison
Rabbi Greer Headed to Prison
That is the headline of an article in the New Haven Independent, and was big news yesterday in the Jewish media and community.
According to the article, Greer was sentenced to 20 years in prison for repeatedly raping a teenage student in the yeshiva he headed.
Such a difficult and horrible story. What is particularly interesting about it is what the judge reportedly said in the sentencing.
Greer stood as Judge Alander read off the sentence for each of the four felony counts of risk of injury to a minor. As soon as Alander said it would involve prison time, a court marshal immediately grabbed Greer’s right hand, pulled it behind his back and put it in cuffs. Greer’s face reddened, and he began shaking.Let the lesson be heard by others in positions of authority who might be tempted, and let victims find solace in this statement. Quoting the Talmud. Betraying trust. It is about time someone made such a statement. Hopefully this is the shot heard around the world and others will take note and act appropriately.
Alander ordered that Greer go straight to jail rather than remain free on bond. He said that’s because he considers Greer a substantial flight risk, as he faces the “cold realization” that he will likely spend the rest of his life behind bars. Alander added that, last time he’d raised the bond to $750,000, his wife, Sarah Greer, had somehow come up with tens of thousands of dollars in cash within just a few hours.
Greer will have to serve only 12 years in prison. After that, the rest of the full 20-year sentence will be hanging over his head as a consequence for violating his probation, which he will be on for up to 20 more years.
Greer will also have to register as a sex offender for 10 years, with a description that says he repeatedly had oral and anal sex with a teenager. He will have to pay a $151 fine, and he will have to give a DNA sample.
“Why does society view these crimes as particularly deplorable? Why have they garnered such significant media and public attention? Because they involve a colossal violation of trust,” Alander said.
“When, as parents, we send our children to school and take them to houses of worship, we entrust the leaders of those with the care of our children. We share an unspoken promise in understanding that our children will grow and prosper under their tutelage. When a teacher or religious leader breaks that promise, they betray that trust. It is both unexpected and deeply disturbing.”
“It is important that a statement be made, to be heard by others in positions of authority who might be tempted; to be heard by the victims of sexual abuse who may find some solace in it,” Alander continued. “The Talmud [a primary source of Jewish rabbinic law] teaches that there is hope for a man who is capable of being ashamed. It is my hope that someday you will truly feel ashamed for your actions and thereby embark on the road to redemption.”

is child abuse more shocking or damage to prisoner rights more shocking?
Kikar has an article about a couple of Haredi women from Beitar Ilit who are in prison (Neve Tirza) for child abuse in their work as nursery school teachers. The article is about a claim made by their lawyer saying that the women were treated poorly in jail and made to remove their hair covering and to wear "training" pants - against their religious beliefs and lifestyle.
The lawyer, Tali Gottleib, says that despite she herself being secular there is nothing more shocking than such a serious breach to the honor of a woman or to a person and her right to her faith.
I think it is horrible that their human rights were trampled. Even prisoners deserve to be treated fairly and are deserving of having their faith and religious sensibilities considered and protected. That being said, I do know something more shocking than the trampling of these women's basic rights of faith and religious beliefs - that is, beating up on little kids in their care is far more shocking than the fact that the prison guard made them uncover their hair.

Let's Stay Safe
Rabbi Yakov Horowitz does tremendous work in the realm of child safety. He recently launched a child safety book "Let's Stay Safe", and more recently has been launching versions of this book in other languages, including one in Hebrew for the Dati Leumi community and another in Hebrew for the Haredi community (I do not know what the differences are in the book).
Personally, both for my kids and to support Rabbi Horowitz's efforts, I just picked up the Hebrew version of the book:
this is the Haredi version of the book, whatever that means..
you can get these books at any decent Jewish bookstore. In RBS I got it at the Judaica Center bookstore (under Yesh).

Rabbi Grossman revokes his support for monster Malka Leifer
Rabbi Grossman, Chief Rabbi of Migdal Emek and founder and driving force behind a major organization in which he works to care for abused, abandoned and forgotten children, among other things, was recently involved in the Malka Leifer case in which he went to court to vouch for her, in some capacity, and offered to house her in his home with the conditions of house arrest while she would await trial.
There was a large outcry online calling him out for his support of Leifer, even if unintentional, thus increasing the pain of her victims in the process.
Initially Rabbi Grossman made statements expressing his lack of understanding as to the problem, as he says he was just trying to have compassion and help her but she would have jail terms in his house. He did not see how his helping her was hurting others.
Rabbi Grossman has now seen the light, and I don't care if it was because of pressure even if he still does not understand or if now he understands. Rabbi Grossman released a statement to the press last night in which he says that he revokes his support for Leifer and withdraws his involvement in the case.
The full statement, from Kol V'Oz:

The full statement, from Kol V'Oz:
Statement from Rabbi Yitzhak Dovid Grossman: Last night, I notified the courts that I am completely withdrawing my involvement in the case of Malka Leifer, and my recommendation that she be placed under house arrest with my supervision. For more than fifty years I have devoted myself to helping thousands of children who have been abandoned, orphaned or abused as well as those living in the forgotten margins of Israeli society. In addition, I have gone into the prisons to help those who need to be reached out to. My focus and the focus of Migdal Ohr will always be to help and heal Israeli society. At times, I have been called upon by the courts and the Government to act as impartial mediator when no other alternative exists. This was the case with this last request. In these difficult and highly charged situations, I have had to find a balance between my life's goals for Migdal Ohr and the needs of Israeli society. I am very sensitive to the pain and plight of children and adults who are abused, as I see it every day in my work at Migdal Ohr. It is regretful that the current turmoil has in any way called into question that mission and dedication.I called him out for his supporting Leifer, the monster, and now I commend him for doing the right thing, for seeing how harmful that would have been, both to her victims and to his life work of protecting and helping children who are victims themselves and for doing the right thing and not putting himself in a position where she can use him and show him as supporting her.
