Interesting Psak: Shabbos elevator in RBS D

This exact story happened in my building 25 or so years ago. I personally was involved in the sense of helping an elderly and unwell neighbor who lived on a higher floor. At the time the people involved did not go to a beis din but went to a local rav to resolve the dispute.

Behadrei is reporting on a dispute in a building in RBS D. The building is 8 stories tall and residents living on the upper floors (including an elderly resident) want to use the Shabbos Elevator that was included in the building by the original kablan, which they iostensibly planned to benefit from when they bought their apartments, and everyone who purchased in the building knew this was an included feature which their apartment price included. They say they purchased the right to use the Shabbos elevator. Preventing them form using it will prevent them from being able to be mobile in general and even from going to shul sometimes on Shabbos and holidays.

Other neighbors oppose the use of the Shabbos elevator in the building in which they reside. They make claims of it being harmful to the education of their children, damaging to the spiritual atmosphere of the building and neighborhood.

Unable to resolve the matter amongst themselves, they agreed to go to a beis din for a decision.

The beis din heard both sides and their positions, and after weighing the matter has come to a decision.

The beis din stressed the issue of the holiness of Shabbos, the special charchter of Bet Shemesh and the sensitivity of the Haredi community to the operation of electrical systems on Shabbos, while also taking into consideration the the rights of the residents who purchased this ability when they purchased their apartments and that the shabbos elevator was installed as an original part of the building (rather than them requesting to add it at a later stage).

The beis din came up with a plan for a comprise by which the Shabbos elevator would be operating on a limited schedule, only certain hours of the day rather than over the entire Shabbos, and some other limitations (I imagine only stopping on the upper floors and the ground floor but not on the lower residential floors). Efforts will be made (nothing is specified so I do not know what the efforts are in real life) to minimize the sense of harm to the charachter of Shabbos, while filling the needs of the residents on the upper floors.

in the case that I was familiar with 25 or so years ago the rav they went to said the Shabbos elevator cannot be relied upon (he did not like the shabbos mode and considered it halachically problematic even bdieved) so the Shabbos elevator was not allowed to go into operation and the fellow above had to stay put on Shabbos and yomtov.

Interesting Psak: Shabbos Kipa

Rav Bentzion Hakohen Kook, a rav in Petach Tikva and dayan in Jerusalem, recently discussed a halacha during his weekly shiur that it is recommended to not wear clothing on Shabbos that you wear during the week.

One of the attendees asked if practically one must have a unique clothing item designated for Shabos or can one wear clothes, such as a shirt, that he also wears during the week as long as it is laundered for Shabbos?

Rav Kook responded paskening that clothing that gets laundered regularly, such as shirts for example, can be worn on Shabbos after having be en laundered. There is no need to have unique shirts designated for Shabbos, just launder them for Shabbos. Clothing items that are not normally laundered regularly, such as tallis katan and a kipa, should be designated and unique for Shabbos.

Rav Kook mentioned that he himself saw this by Rev Elyashiv, his rebbi, and has been doing it himself since; Rav Elyashiv had a hanger with his Shabbos clothes prepared in the closet that held his Shabbos pants, tallis katan, kipa and a vest, all specifically designated for Shabbos. Rav Elyashiv did not have a shirt designated for Shabbos, but would change to a freshly laundered shirt before Shabbos.

According to Behadrei, since this psak was recently publicized there has been a run on kipas and tallis katan in the stiores as many people are running to get themsels new kipas and tallis katan that they would designate just for Shabbos use... When Rav Kook heard about this he gave his approval and said anyone who does thhings for the glory, the honor, of Shabbos will definitely receive the merit of the Shabbos providing protection for him and it will be a segula for protection, and will be given unlimited bounty (as promised in the gemara)....

Personally I have had a designated tallis katan for Shabbos for many years as an adult, for as long as I can remember. When I get a new tallis katan, I generally will rotate it in making the new one my "Shabbos tzitzis" and move my previous Shabbos tzitzis into my weekday lineup... I never had a special SHabbos kipa - maybe it is time to get one... back when I used to regularly wear a black hat, I did have a hat designated for Shabbos..

The USA is celebrating its 250th national birthday this year...

Under the banner of Freedom 250, the USA is running all sorts of celebrations and initiatives. Under the banner of Rededicate 250, a program of national prayer, praise and thanksgiving, on Sunday May 17 the American people will come together at the National Mall to prepare for the 250th birthday with prayer, Scripture, thanksgiving and rededication of the country as One Nation Under God. You can see more about the program at the linked website. Rabbi Meir Soloveichik is listed among the faith leaders who will be participating in the program.

And to that end, President Trump, as posted on the White House website, has called on and encourages all Jewish Americans, with Jewish American Heritage Month being now (May is always Jewish American Heritage Month), to observe a "national Sabbath" - the Shabbos of May 15-16 from sundown to nightfall, friends, families and communities should "come together in gratitude for our great nation", recognizing the sacre Jewish tradition of setting aside time for rest, reflection and gratitude to the Almighty. President Trump further calls " I call upon Americans to celebrate the heritage and contributions of Jewish Americans and to observe this month with appropriate programs, activities, and ceremonies. I further call on all Americans to celebrate their faith and freedom throughout this year, during this month, and especially on Shabbat to celebrate our 250th year."

Trump referenced the famous statement from the first President of the United States of America, George Washington, that said while visiting the Hebrew Congregation in Newport, Rhode Island in 1790 wishing for the safety of the Children of Abraham, and referenced Hayyim Solomon who helped build the nation and work for its independence among other Jews. Trump went on to say he is aggressively fighting antisemitism and religious freedom is a sacred right guiding the nation...

So, keep Shabbos for Trump on May 15... :-) .. He actually does not reference keep halachic shabbos, but rest, reflection and gratitude are great things as well....

Big Gedalya Goomper strikes again!

The US Equal Employment Opportunity Commission came down hard on Mavis Tire Co. for religious discrimination.

Mavis refused to hire a qualified candidate for a managerial psition when he said he would need Friday night and Saturday off as he is Shabbos observant. They then offered him a more flexible technician position but retracted that as well for the same reason.

The candidate sued and was awarded a little over $300k for the discrimination he suffered. Mavis will also revise its policies about religious accomodation and train their relevant staff about these matters.

The Director of EEOC said

“We commend Mavis for their commitment to complying with Title VII’s requirement to accommodate job applicants’ and employees’ sincerely held religious beliefs and practices,” said Arlean Nieto, acting director of the EEOC’s New York District Office. “Employers cannot refuse to hire a job applicant to avoid granting a request for a religious accommodation. Employers need to take reasonable efforts to accommodate an employee’s sincerely held religious belief, unless such an accommodation would pose an undue hardship.”

Discrimination is always bad, so good on them for coming down on Mavis for this.

based on Nieto's last statement, I am wondering what the legal requirements are - what is considered undue hardship? If the position requires the manager to work Saturday, why is it religious discrimiation to not hire an Orthodox Jew? Maybe they couldnt show that it was really a necessary work day and he couldnt do his job properly if he couldnt come on Saturday?

Interesting Psak: Returning to Learn in Israel

Some yeshiva students from Mexico have not returned to their yeshivas in Israel after the Sukkos break because of the war that broke out. Because the war and potential danger, they were unsure whether to return to Israel or not and sent the question to Rav Yitzchak Zilbershtein looking for guidance.

Rav Zilbershtein, rav of Ramat Elchnonon neighborhood of Bnei Braq, referred to the Chafetz Chaim who was asked before World War II in 1933 who would be saved from Hitler if he is successful in wiping out the Jews of Europe. According to the story,

Rav Moshe Londinski, one of the three Roshei Yeshiva of the Chofetz Chaim’s Yeshiva in Radin, inquired of the Chofetz Chaim, “What will be the fate of our brethren in Germany and in Poland?” Rav Londinski pointed out that Hitler y”s had been talking about destroying the entirety of Klal Yisroel for years.

The Chofetz Chaim responded that it is impossible for someone to succeed in wiping out Klal Yisroel in all the lands of the exile and he cited the pasuk (Bereishis 32:4-9) “’If Esav comes to the one camp and attacks it, the other camp will escape.”

At that point, Rav Moshe Londinski zt”l realized that the danger was quite grave. He asked further, “If Heaven forbid, he succeeds in wiping out European Jewry, who and where is the other camp that will survive?”

The Chofetz Chaim answered, “This too is a pasuk, it is in the beginning of the Navi Ovadiah (1:17), “And on Mount Zion there shall be a remnant, and it shall be holy..” Rav Londinski left the Chofetz Chaim’s presence with his hands shaking on the future destruction of European Jewry, but he was assured that the Holy Land will be spared and no sword of the Nazi menace would pass before it.

Rav Zilbershtein says the words of the Chafetz Chaim were accurate. As soon as the German army approached Eretz Yisrael, that brought about their downfall. We are now in the times of the birth pangs of Mashiach and the nations of the world have increased their hatred of the Jews around the world. No place is safe and calm and only Hashem saves us from them.

Because the Torah learning protects, especially in the land of Israel where there is special protection, the Yeshiva students should return and have nothing to be concerned about and will be safe.

That being said, Rav Zilbershtein added that the boys should take on additional learning, including learning at least two laws of Shabos daily and the merit of Shabbos will add additional protection.

Chazon Ish's protection extended

In a shiur recently, Rav Yitzchak Zilbershtein mentioned that Bnei Braq is a safe city, the safest in the world, and the residents do not need to worry, as the Chazon Ish promised, and it was supported later by Rav Chaim Kanievsky, that bombs will not fall in Bnei Braq.

Rav Zilbershtein was asked if the promise of the Chazon Ish extends to Modiin Ilit and other Haredi towns.

Rav Zilbershtein responded that while the Chazon Ish himself never said so about any place other than Bnei Braq, and he himself (ie Rav Zilbershtein) cannot stand in the place of the Chazon Ish to extend the promise, but it is clear that the promise was based on the Shabbos observance of the residents of Bnei Braq. Any place that observes the Shabbos - the promise and security applies equally to that place, and bombs will not fall there.

If it provides people some comfort and calmness, more power to him!

I would note, that there are plenty of towns across Israel that are fully shomer shabbos, and it isnt just limited to Bnei Braq and Modiin Ilit or even just to all haredi towns, though I would note that just this past Thursday a rocket landed and exploded in Beitar Ilit, a fully Haredi and shomer shabbos town, with several injured (thankfully nobody was killed). If Rav Zilbershtein is correct, they should all have this protection of the promise of the Chazon Ish, and I hope they all do.

I do wonder if the protection of the Chazon Ish promise requires the entire city to be shomer shabbos or can neighborhoods within a city get the promise applied as well if the entire city isnt necessarily shomer shabbos but some neighborhoods within area. I suspect it does. Even Bnei Braq isnt fully shomer shabbos, though today the bulk of it is. In the time of the Chazon Ish there was a significant portion that was not, such as the Pardes Katz neighborhood, among others. Even today, while Pardes Katz is more frum than it used to be, it still isnt fully Haredi.

Interesting Psak: Shabbos at War

In light of the ongoing war with Hamas and the threat of danger and incoming rockets at any time, the Chief Rabbis of Israel, Rabbi Dovid Lau and Rabbi Yitzcha Yosef, have issued a psak to the general public regarding what is needed to do over shabbos at this time.

They paskened that:

1. All instructions and guidelines from the Home Front Command must be strictly observed. If they say to stay home, stay home and dont go out, even for prayer services

2. Daven only in a shul that has, or has nearby, a protected area. Elderly and those who are unwell and walk too slowly, should daven at home and not go to shul

3. Whoever holds a license to carry a gun has a mitzva to carry the gun with him on Shabbos

4. If a siren is heard during the shmoneh esrei tefilla, go quietly to the protected area and then continue davening from where you left off

5. Try to have at least one armed person in every shul

6. Every shul should have a phone, placed there on Friday, to be available for use. When necessary one can keep his phone on silent and vibrate in his pocket

4. Leave the radio on tuned to the silent station to be updated by Home Front Command should it be necessary

Hatzlacha and hopefully it wont be necessary and will just be a precaution

Back in the day, religious Jews and pro sports just weren't synonymous. Today things might be different. It is getting less rare to see Orthodox Jews trying to make that move, and even if just to be good enough for consideration.

We have got a couple of Orthodox kids recently in the MLB draft, Ryan Turell in the NBA draft and now playing in the minor leagues, occasionally making a cool spin move in a game that makes it to a Youtube clip, and we have had some others like the young lady from Teaneck who is a master at Table Tennis, Beatie Deutsch the marathon runner, and others.

Now another two orthodox kids are in the rise in the sports world.

Sam Salz is the first Orthodox shomer shabbos young man to play college football. According to COLLive, Salz chose 39 as his uniform jersey number to be a reminder to him about adhering to the 39 melachos of Shabbos. Salz plays running back for Texas A&M, after playing High School football in Merion Pennsylvania. He says he has to sit out half the games because of Shabbos and for games that start after Shabbos he walks to the stadium.

Moriah Rimon, daughter of the famous Rav Tzvi Rimon (a leading Dati Leumi rav), is an international champion (bronze medal) in Taekwondo. She has been training and competing since 2nd grade and is currently performing her national service in Sherut Leumi working with kids at risk in Jerusalem.

Rimon says one of the greatest challenges for her in her sport is Shabbos. She does not compete on Shabbos and has to forgo many tournaments and competitions because of it.

Good luck to them all. It is going to be interesting to see them and others who will surely come along in time, navigate the challenges...

Forer on a roll

Minister of Agriculture Oded Forer is on a roll.

Just last week Forer proposed a method to increase competition in the pork industry in Israel in order to bring about the lowering of prices. 20 years ago regulations were put into place restricting the slaughter of pigs and is currently limited to 3 slaughterhouses and processing plants, one in the north, one in the south and one in the Galilee. Forer is working on removing those restrictions and allowing the establishment of slaughterhouses for pork wherever one might want to open them, limited only by the veterinary services.

It should be noted that this move to remove the restrictions is part of a broader reform removing restrictiosn on the establishment of all slaughterhouses. This greater reform would make it easier to open slaughterhouses for beef and lamb pretty much anywhere around Israel. As part of that, the restrictions on pork slaughterhouses would also be eased.

Unless really it is the other way around. Maybe Forer is easing the restrictions on cattle slaughterhouses just to be able to remove them for pork... hmmm

Obviously Forer's submission of a draft on this matter raised quite a ruckus. Pork is not just "treif" but is probably the greatest symbol of treif and something that Jews repelled and rejected even more than other treif foods throughout the generations (possibly until and not including today's younger generation).

That was last week.

This week Minister Forer has another proposal that will upset many among the religious and Haredi sectors.

Forer has requested that the Chief Rabbis of Israel, Rabbis Yitzchak Yosef and Dovid Lau, investigate and research the possibility of allowing non-Jewish workers work in the dairy farms on Shabbos and holidays. These workers would perform activities such as cleaning and maintenance of the production lines. Because of the upcoming holidays and how they land on the calendar with Shabbos and holidays interspersed, a shortage of milk is expected as the number of work days available will be significantly lower than normal.

For the first regulations he didnt need the Chief Rabbis because it is the non-kosher market and they are not connected to that. For the milk, it all has to be kosher, so he would need their approval.

I wonder what he'll go for next.

Sirens for Shabbos in Tel Aviv

In less religious neighborhoods people like to complain about the Shabbos sirens that some people operate on Friday as Shabbos begins. In fully Haredi neighborhoods, and I think in most or all Dati neighborhoods, the Shabbos siren has become a fixture. it just exists. The problem, the conflict or friction, happens when religious people move into a not-religious area and introduce the siren to people who never had it and do not particularly want it. By the way, in different areas the siren might be different types of music or an actual siren...

Personally, I am fine with the siren. The one thing that I dont like about it is that in a big religious area like where I live there is not just one siren, but 3 or 4, and of course the people operating them can't be bothered to coordinate among each other. So Friday afternoon as Shabbos approaches, we get to hear 3 or 4 sirens, not knowing what each one is alerting us to (40 minutes? 20 minutes? a bit before 40 minutes so we know it is coming? etc).

And in some places they have the opposite problem.

According to Kipa, many religious French people have been making aliya and moving to cities like Netanya, Tel Aviv, Ashdod, and other cities and neighborhoods that do not necessarily have a religious flavor to them, along with many others who go to these areas for short term stays and visits. Because these are not natively religious areas they generally do not have these sirens in place, and the community representatives say the residents often do not know enough Hebrew or where to look for the information, and having a siren announce the upcoming arrival of Shabbos would be very helpful.

These people have put out a call to Ron Huldai to allow a siren in Tel Aviv to announce the approaching Shabbos. They specifically requested a siren be sounded ithe areas of the midrachov, a popular pedestrian walkway, and the boardwalk (I think this is the boardwalk along the beach)...

I havent seen any word yet from Huldai if he plans to approve this or reject the request. It seems to me that it would be more likely to be approved if it was being requested for a religious area where a significant portion of the residents wanted it and benefited from it. It seems less likely to me that in places like these, the boardwalk and midrachov, such a request will be approved. but we wait and see.

Proposed Law: buying Shabbos wine after 11

How many times have you gone out to do your weekly shopping late at night, 10 or 11pm, just because that's when you were available to go? Sure enough, and this has happened to me, you walk around the supermarket getting everything you need for the coming week and Shabbos, including a bottle of wine for Shabbos. By the time you get to the checkout counter, it is past 11pm and the store is no longer allowed to sell you the wine so they stop your purchase and make you remove the wine.

What a pain in the neck. Just because to prevent alcoholism and the like the law bans purchase of alcohol late at night.

Even though this law can be a pain in the neck, I am not sure it should be changed, if it has been proven to accomplish the goal it sets out to accomplish.

MK Uri Maklev (UTJ) has proposed a law that would make an exception to the above law and allow the sale of wine on erev shabbos (Thursday night) and erev chag even after 11pm. The limit on Thursday nights and erev chag would be moved to 1am.

Maklev says the law in its current state is a major bother for consumers going at night to make their Shabbos purchases. They are not buying this wine to drink now, late at night, maybe drive drunk, maybe get into fights or become public nuisances, and the like - they are buying it now for the upcoming Shabbos or holiday.

The Ministerial Legislative Committee has approved the proposal to move forward in the process for voting.

Maklev is 100% right. But. But even if he is right, not everyone buying the wine or beer or liquor on Thursday nights is buying it for Shabbos and not going to drink it and get drunk on Thursday night. The original law is to prevent that, and if it does, maybe it should be kept, even though some people are inconvenienced by it. Personally I think it should be entirely scrapped unless it had can shown to having a significant effect in the prevention of alcoholism, but if this law is deemed necessary and beneficial in achieving its goals, then Maklev's exception should be denied. If we make the exception, people buying for reasons other than Shabbos will take advantage of it.

not losing because of Shabbos

Srugim is reporting on a story first publicized by Sivan Rahav Meir.

A young man on Kibbutz Tirat Tzvi, a religious kibbutz in northern Israel, named Nateh Eiger in 11th grade qualified for an international competition in chemistry. He traveled to Europe to participate in the event. 5 other young chemists went from Israel to participate along with Nateh. Eiger advanced through the first two rounds with excellence but had to bow out when he discovered the third round would take place on Shabbos.

While it seems organizers had promised Eiger that if relevant he would be able to do his presentation no either Friday or Saturday night, when push came to shove they did not allow him to and he decided to bow out of the competition rather than to be mechalel shabbos.

He left the event early and went home for Shabbos where his community prepared a grand welcome to celebrate his success and his decision that Shabbos has priority, despite having prepared 3 years for this.

That is an amazing story. This is a kiddush hashem. And Nateh Eiger is a direct descendant of the great and famous Rabbi Akiva Eiger. I am sure he is shepping nachas right now up there..

Kikar adds another twist. MK Uri Maklev (UTJ) has called upon the Ministry of Education to award Eiger with some sort of respectable compensation for this. Maklev says the system should stand behind Eiger, and as a Jewish state, keeping Shabbos is a central value held by the State. Eiger should not lose because of Shabbos. Minister of Education Yifat Shasha Biton said she would consider it, and would look into making official arrangements for future international competitions so things like this should not happen again.

Eichler always has a sharp and witty way about him, and even when I disagree with his efforts and opinions, he always has something sharp to say that is worth listening to. In this case I agree. Public transportation is inadequate in so many ways and in so many parts of the country - she might first put her efforts to making public transportation reliable and efficient in general, during the week when it is most needed, especially as Merav Michaeli repeatedly says she wants more people using public transportation and fewer using private cars.

This reminds me of the famous story I heard of an MK pleading with then Prime Minister Moshe Sharet (I think it was him) to move Israel to a five day workweek, instead of a six day workweek. His respsonse was that first we should get the Israelis to work one day a week, then 2, then 3 and eventually we will get them up to working five days a week..
