Chinuch Atzmai goes to court - secular court

The biggest of the hullabaloo surrounding the Emannuel case was that how could Yoav Lalum take the case to the Supreme Court? How could he go to secular court rather than to Beis Din.

The same has been asked and accused of a number of other cases - the sephardic girl who was not accepted to a school in Bet Shemesh is an example of fthe top of my head. They went to court so clearly they are not bnei torah and are not appropriate for this school anyway!

Yet we see time and again that the ashkenazy community has no problem bringing their own internal fights for resolution in the secular courts, and it is considered normal and nobody gives a hoot.

This was true for the fights in Ponevezsh yeshiva when they went to court to determine who rightfully owned the yeshiva and who could be rosh yeshiva. It held true in other cases.

And sure enough it holds true today as Chinuch Atzmai itself is also going to secular court to determine who should be appointed the director of chinuch atzmai.

When we do it, it is ok. When other people do it, they are raising their hand up against Hashem and have removed themselves from the frum community.

And to make matters worse, the leaders of Chinuch Atzmai have now sent a petition to the Chief Rabbi and officials in the Ministry of Religious Affairs and the Religious Council, to fire Rav Yaakov Yosef from his position as rav of a neighborhood, and to remove form him the title of Rav. They claim his attack in secular court against the haredi community as proof of the necessity for such a move.

On the same day we find out in the news that Chinuch Atzmai themselves are going to secular court to settle their internal dispute, they have the chutzpa to demand Rav Yosef be fired for what is essentially the same exact thing.

  1. But they did go to Beit Din first. The school refused to listen to the Beit Din, even though the system of Borer Ehad was used, and so the resorted to the secular courts.

  6. right sure. The chinuch atzmai peopel definitely went to beis din and got a hetter, while there is no way the other people did.

And by the way, just like I have no idea which beis din lalum went to, I also have no idea which beis din CA went to.

  7. Rav Yaakov Yosef is probably smarter and more equipped to be a Rabbi than any of the Rabbis calling for his demise. There is a great Rabbi willing to stand up against these thugs, they have to get rid of him. This stuff just disgusts me!

  8. The problem is not who gave them a heter to go to secular courts but rather why don't they listen to Beis Din?
